Terms and conditions
This is the agreement between you and the operator of this site. It covers who may hold an account, what an account is for, what is not allowed, and what happens when something goes wrong. Specific online gaming conditions apply on top of it for online participation.
01 Who you are contracting with
This site is operated by Société des loteries du Québec, also designated as Loto-Québec, a corporation with its registered address at 500 Rue Sherbrooke Ouest, Montréal, QC H3A 3G6, registered in Québec under NEQ 1144330454.
The operator carries out its activities under the Act respecting the Société des loteries du Québec (CQLR, c. S-13.1) and the by-laws made under it. Those instruments prevail over anything written here: where this document and the applicable legislation differ, the legislation applies.
02 Accepting these terms
Using this site means accepting these terms. Opening an account means accepting them together with the specific online gaming conditions of use and the privacy policy.
If you do not accept them, do not open an account and do not participate. Reading the pages of this site does not require an account and creates no obligation beyond the ordinary terms of use set out here.
03 Who may hold an account
Four separate requirements apply, and all four must be met. They are often confused with each other, so they are stated apart:
- Age. You must be 18 years of age or over. Age is determined from the date of birth recorded on the account, not from a declaration.
- Residency. An account is intended for residents of Québec, and the address on the account must be a Québec address.
- Location. Participation is permitted only when you are physically located where participation is allowed. This is checked independently of your residency.
- Identity. Your identity must be capable of verification by the operator. Verification is a separate stage that follows registration.
An account may not be opened by a person who is currently self-excluded, nor on behalf of another person.
04 Registering an account
You must provide accurate and complete information when registering, and keep it up to date afterwards. Information that does not match your official identification will prevent verification and may lead to the account being suspended.
One account per person. Accounts are personal, non-transferable, and may not be shared, sold, or operated by anyone other than the holder.
05 Identity verification
The operator verifies the identity of account holders. Verification may take place at registration or afterwards, and may be repeated where circumstances require it.
Until verification is complete, functions on the account may be restricted. Where verification cannot be completed, the account may be closed and any participation dealt with under the conditions that apply to it.
06 Account security
You are responsible for keeping your sign-in details confidential. Do not reuse a password from another service and do not share it with anyone, including people who claim to represent the operator — the operator will never ask for your password.
If you believe someone else has access to your account, change the password and notify the operator without delay. Activity carried out through your account with your credentials is treated as yours unless the contrary is established.
07 Participating in games
Participation is subject to the rules of the game concerned, made under the Act. Those rules determine how a draw is conducted, what constitutes a valid participation, how prize categories work, and the deadlines that apply.
Sales close before each draw. A participation registered after the cut-off applies to the following draw. A participation is only valid once it has been registered in the operator’s system.
08 Money in an account
Deposits, withdrawals and any balance held on an account are governed by the specific online gaming conditions of use and by the applicable rules. Payment methods available at any time are shown in the account.
Account balances are not a banking service: they do not bear interest and an account may not be used as a means of transferring money to another person.
09 Errors, interruptions and void participations
A technical fault, a display error or an interruption does not create an entitlement. Where an error affects a participation or a result, the position is determined by the operator’s system records and by the rules of the game concerned.
A participation may be void where it was not properly registered, where it was made after the applicable deadline, where it was made in breach of these terms, or where the applicable rules provide for it. In that case, what happens to the amount paid is determined by those rules.
10 What is not allowed
- Opening or using an account on behalf of another person, or allowing another person to use yours.
- Holding more than one account, or opening a new account while excluded or suspended.
- Providing false information, or documents that are not genuine.
- Using automated tools, scripts or any means of interfering with the site, its systems or other users.
- Attempting to access parts of the system you are not authorised to access.
- Using an account in connection with any unlawful activity, including the laundering of proceeds of crime.
Conduct of this kind may lead to suspension or closure of the account and may be reported where the law requires it.
11 Responsible gambling
Gambling is a form of entertainment and must not be treated as a source of income. Participation is restricted to adults.
Limits, breaks and self-exclusion are available from the account. A lower limit applies immediately; an increase takes effect only after the delay set out in the specific online gaming conditions of use. A self-exclusion cannot be lifted before the end of the period chosen.
Free and confidential support is available in Québec through the Gambling: Help and Referral service, whether or not you hold an account.
12 Suspension and closure
The operator may suspend or close an account where these terms or the applicable rules are breached, where verification cannot be completed, where the law requires it, or where there are reasonable grounds to protect the account holder or the integrity of the games.
You may close your account at any time. Closing an account is an administrative step and is not a protective measure: it does not have the effect of a self-exclusion, and a closed account can be reopened.
13 Personal information
Personal information is handled as described in the privacy policy, which forms part of this agreement. It sets out what is collected, why, how long it is kept, to whom it may be communicated, and how to request access, correction or the withdrawal of a consent.
14 Complaints
A complaint should first be addressed to the operator, with enough detail to identify the account and the participation concerned. The operator’s system records are the reference for what took place.
Where a matter cannot be resolved directly, the recourse available under Québec law remains open to you. Nothing in this document limits a right you hold under the applicable legislation.
15 Governing framework
This agreement is governed by the laws applicable in Québec and by the federal laws of Canada that apply there, including requirements relating to the proceeds of crime and terrorist financing.
The courts of Québec have jurisdiction over any dispute arising from this agreement.
16 Changes to these terms
These terms may be amended, in particular where the applicable rules change. The date of the current version appears at the top of this page.
Continuing to use the site or the account after an amendment means accepting the amended terms. Where an amendment is significant, it will be communicated through the account.
